Video production contract template

Video is the freelance discipline with the most third-party risk: crew, talent, locations, music, and a client who wants a version for a channel nobody mentioned. This agreement puts an owner on each of those and defines what the client owns at the end.

Say who owns the raw footage, because the default surprises people

Clients often assume they are buying everything that was recorded. The normal position is that they are buying the finished films, and the raws stay with the production — they are unusable without your project files anyway, and handing them over invites someone else to recut your work badly with your name attached. If a client wants the raws, it is a priced deliverable with a media cost, not an afterthought.

Music and talent licences have edges the client cannot see

A library track licensed for organic social does not cover paid media. Talent booked for a six-month usage term is a liability the day it expires. Put the licence terms and their expiry dates in the contract and repeat them at delivery. When the campaign gets extended in month seven, you want the client discovering the cost from your paperwork rather than from a rights holder's letter.

Weather days, overtime, and the kill fee

These three clauses cover almost every way a shoot loses money. Weather: postpone by mutual agreement before a stated time, no production fee, committed costs still payable. Overtime: a per-hour, per-crew-member rate called by the client in writing on the day. Kill fee: cancel within [7] days and half the day's fee plus all non-cancellable costs are due, because the crew has already turned down other work.

Production law reaches further than the contract

Production contracts touch employment status for crew, on-set safety law, insurance requirements, minors on set, drone and location permits, and music rights — all of which vary by jurisdiction and sometimes by city. Use this as the structure, then get it reviewed locally before a shoot with real budget behind it.

VIDEO PRODUCTION AGREEMENT

1. THE PROJECT
1.1 Production will produce [project name] as described in the scope of
    work dated [2026-04-03], attached as Schedule A (the "Project").
1.2 Deliverables, shoot dates, crew, and versions are as listed in
    Schedule A. Where this agreement and Schedule A conflict, this
    agreement wins except on the description of deliverables.

2. FEES AND PAYMENT
2.1 Production fee: $[28,000.00], plus pass-through costs under 2.4.
2.2 Payment schedule:
    · [40]% ($[11,200.00]) on signature — non-refundable; it books crew,
      kit, and locations.
    · [30]% ($[8,400.00]) on the first shoot day.
    · [30]% ($[8,400.00]) on final delivery.
2.3 Invoices are payable within [14] days. Late amounts accrue interest
    at [1.5]% per month, or the maximum permitted by law in
    [jurisdiction] if lower.
2.4 Pass-through costs — talent fees, location fees, permits, catering,
    travel, hire equipment, and music licences — are billed at cost with
    receipts, and are approved in writing before being incurred.
2.5 A standard shoot day is [10] hours on location including setup and
    wrap. Overtime is $[150.00] per hour per crew member, called by
    Client's named representative on set in writing.

3. SCHEDULE, WEATHER, AND CANCELLATION
3.1 Shoot dates are as in Schedule A and are held exclusively for
    Client from signature.
3.2 Weather: if an outdoor shoot day is unsafe or unusable and both
    parties agree before [07:00] on the day to postpone, the day moves
    to the contingency date at no additional production fee. Crew, kit,
    and locations already committed and non-refundable remain payable.
3.3 Cancellation by Client of a shoot day within [7] days of it: [50]%
    of that day's production fee plus all non-cancellable costs.
    Within [48] hours: [100]% of that day's fee plus costs.
3.4 Cancellation of the whole Project after work has begun: all fees for
    work completed, all committed non-cancellable costs, and a kill fee
    of [50]% of the remaining unearned production fee.
3.5 If Client's approvals, assets, or access are more than [10] business
    days late, delivery dates move and re-booking the edit is charged at
    $[650.00] per day.

4. REVISIONS
4.1 [Two] rounds of revisions on the edit are included.
4.2 A round is one consolidated set of timecoded notes from Client's
    named approver, returned within [5] business days.
4.3 Additional rounds: $[450.00] each, agreed in writing first.
4.4 Changes after picture lock — new script direction, re-shoots, a
    different edit structure — are quoted as a change order.
4.5 Deliverable versions beyond those in Schedule A are $[225.00] each.

5. OWNERSHIP AND LICENCES
5.1 On payment in full, Production assigns to Client all copyright in
    the finished films listed in Schedule A, worldwide and in
    perpetuity, for the media described in 5.4.
5.2 Until payment in full, Client has a licence to view and review the
    cut internally only. Review versions carry a watermark and may not
    be published.
5.3 Raw footage, project files, edit timelines, and unused takes remain
    Production's property. Client may purchase the raw footage for
    $[100.00] plus media cost; project files are not transferred.
5.4 Third-party rights that Client must respect after delivery:
    · Music: [track / library], licensed for [web and organic social,
      worldwide, 3 years from [2026-05-20]]. Paid media, broadcast, and
      out-of-home need an upgrade, which Production can quote.
    · Talent: [name(s)], engaged for [12] months usage from first
      publication, in [named territories and media]. Extending usage
      requires a further fee to the performer.
    · Stock footage, fonts, and plugins remain under their own licences.
5.5 Client is responsible for staying within these terms after delivery.
    Production will provide a written summary of every licence and its
    expiry date with the final files.
5.6 Production may show the finished work in a portfolio, showreel,
    website, and awards entries after Client's launch date of
    [2026-06-01].
5.7 Credits: [Production is credited as "Produced by [name]" in the end
    card of the hero film] / [no on-screen credit is required].

6. PRODUCTION AND SAFETY
6.1 Production is responsible for crew engagement, call sheets, risk
    assessments, and on-set safety, and holds [public liability and
    equipment] insurance. Certificates are available on request.
6.2 Client is responsible for access to its premises, internal
    permissions, and the accuracy of any product claims featured.
6.3 Client may have up to [3] representatives on set. Additional
    attendees need advance notice.
6.4 Production may stop work where conditions are unsafe or unlawful.
    Fees for the day remain payable.
6.5 Anyone appearing on camera signs a release before filming.
    [Client / Production] is responsible for obtaining releases from
    Client's employees and customers.

7. DELIVERY AND ARCHIVE
7.1 Final files are delivered via [delivery platform] in the formats in
    Schedule A, with a caption file per version.
7.2 Project files and raw footage are held online for [90] days after
    final delivery, then archived. Retrieval afterwards: $[150.00],
    subject to availability. Production is not a backup service and
    Client should keep its own copies.

8. WARRANTIES AND LIABILITY
8.1 Production warrants that the Project is its original work except
    for identified third-party assets, that it has the rights it grants
    here, and that it will perform with the skill and care expected of a
    competent professional.
8.2 Client warrants it owns or is licensed to use everything it supplies
    — brand assets, product, music, footage, and claims — and will
    indemnify Production against claims arising from them.
8.3 Neither party is liable for indirect or consequential loss,
    including lost profits or campaign performance.
8.4 Production's total liability is limited to the total fees paid by
    Client under this agreement.
8.5 Nothing limits liability for death or personal injury caused by
    negligence, for fraud, or for anything that cannot lawfully be
    limited.
8.6 No guarantee is given about views, engagement, or any commercial
    outcome.

9. GENERAL
9.1 Governing law: [jurisdiction].
9.2 Confidentiality: each party keeps the other's confidential
    information private for [3] years after the Project ends.
9.3 Force majeure: neither party is liable for delay caused by events
    outside its reasonable control, with prompt notice.
9.4 Changes must be in writing. Email is acceptable for change orders.
9.5 This agreement plus Schedule A is the whole agreement.
9.6 If any clause is unenforceable, the rest stays in force.
